1. Description of Services

Elera Health provides a digital health platform designed to support occupational therapy providers and their patients. Features may include:

• Appointment scheduling
• Intake and assessment tools
• Telehealth functionality
• Secure messaging
• EHR, documentation, and billing tools
• Provider dashboards and patient portals
• Calendar integrations
• Automated administrative workflows

The Services support care delivery but do not replace medical advice or emergency services.

2. Eligibility

You must be at least 18 years old to create an account.

For pediatric care, all information must be provided by a parent or legal guardian.

3. Account Registration

To use certain features, you may be required to create an account. You agree to:

• Provide accurate and complete information
• Keep your account information updated
• Maintain the confidentiality of your login credentials

You are responsible for all activity under your account.

4. Acceptable Use

You agree not to:

• Use the Services unlawfully or for unauthorized purposes
• Interfere with or disrupt our systems
• Misuse data or attempt unauthorized access
• Upload harmful, misleading, or inappropriate content

We may suspend or terminate your account if you violate these Terms.

5. Communications

You may receive operational emails related to your account, such as:

• Appointment confirmations
• Intake form notifications
• Platform updates

SMS consent is separate and optional. Opting into SMS is not required to receive care or use the Services.

5a. SMS/Text Messaging Program

Program Description

Elera Health SMS Alerts is a non-marketing, care coordination text messaging program. If you separately opt in, you may receive SMS messages related to:

• Appointment reminders
• Scheduling updates and confirmations
• Intake form links
• Care coordination messages

We do not send promotional or marketing SMS messages.

Message Frequency

Message frequency varies.

Costs

Message and data rates may apply.

Opt-Out

To stop receiving SMS messages at any time, reply STOP to cancel. After opting out, you will receive one final confirmation message and no further messages will be sent.

Reply HELP for help. For additional support, contact us at support@elera.health.

Number Changes

If you change your mobile phone number, it is your responsibility to notify us. However, failure to notify us will not result in any liability to you.

Privacy

SMS data is handled in accordance with our Privacy Policy (https://getelera.ai/privacy).

6. Google OAuth Integrations

Some features integrate with Google services. By connecting your Google account, you authorize Elera to:

gmail.readonly

Access only emails relevant to appointment confirmations, intake forms, or care coordination for syncing and workflow automation.

gmail.send

Send care-related, non-marketing emails on your behalf (e.g., reminders, instructions).

We do not read, modify, or store unrelated personal emails.

calendar (read/write)

View, create, and update appointment events on your connected Google Calendar.

Our use and transfer of Google user data adheres to the Google API Services User Data Policy, including the Limited Use Requirements.

7. Intellectual Property

All content, materials, and technology within the Services are owned by Elera Health or our licensors. You may use the Services only as permitted by these Terms.

8. Disclaimers

The Services are provided “as is” and without warranties except those required by law.

Elera Health does not provide emergency medical services.

If you are experiencing a medical emergency, call 911 immediately.

9. Limitation of Liability

To the fullest extent permitted by law, Elera Health shall not be liable for:

• Indirect or consequential damages
• Data loss
• Service interruptions
• Third-party system failures

Some jurisdictions do not allow all limitations.

10. Termination

We may suspend or terminate your account if you violate these Terms or use the Services improperly.

You may stop using the Services at any time.

11. Changes to These Terms

We may update these Terms periodically. Changes will be posted with a revised effective date. Continued use of the Services constitutes acceptance of the updated Terms.
